Terms of Service

These Terms of Service (“Terms”) govern access to and use of the XTruLink Guest Experience Platform and related services provided by SwipeTrack Solutions, LLC (“SwipeTrack,” “we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree with these Terms, you may not access or use the Services.

1. The Services

The XTruLink Guest Experience Platform provides ticketing, membership management, digital credentialing, operational workflows, and related features for cultural institutions, attractions, and nonprofit organizations.

We may modify or enhance the Services in our discretion as long as such changes do not materially reduce core functionality.

2. User Accounts & Responsibilities

You are responsible for:

  • Keeping account credentials secure

  • Ensuring authorized user access only

  • Complying with these Terms and all applicable laws

You agree not to:

  • Attempt to access non-public systems or data

  • Probe or test security features without authorization

  • Modify or reverse engineer any part of the Service

  • Upload malicious code or violate usage limits

We may suspend access for security concerns or misuse.

3. Customer Data & Privacy

Customer organizations maintain control and ownership over the personal data they submit to the Service.

SwipeTrack processes Customer Data only to provide the Service and consistent with our:

Personal information is handled in accordance with:

  • SOC 2 security principles

  • Applicable privacy laws (e.g., GDPR/CCPA where required)

4. Third-Party Services & Subprocessors

Some functionality relies on authorized subprocessors such as hosting, networking, and payment providers.

SwipeTrack ensures subprocessors follow appropriate confidentiality and security controls.

5. Service Availability

SwipeTrack uses commercially reasonable efforts to maintain reliable access to the Service. We may perform scheduled maintenance and will communicate outages where practicable.

Customer-specific SLAs, uptime standards, and support commitments may be defined separately in a written agreement or Order Form.

6. Intellectual Property

SwipeTrack retains ownership of all intellectual property within the Service.

You retain ownership of your Customer Data.

You may not reproduce, distribute, or create derivative works from the Service except as expressly permitted in writing.

7. Acceptable Use

You agree to use the Service responsibly and not in a way that:

  • Violates laws or regulations

  • Harms the security or performance of the Service

  • Infringes or abuses the rights of others

SwipeTrack may disable access for violations.

8. Termination

We may suspend or terminate access if:

  • Required by law

  • A security event requires prompt action

  • Terms are violated in a material way

Upon termination, Customer Data handling will follow our Privacy Policy and Data Retention standards.

9. Liability Limitations

To the maximum extent permitted by law:

  • The Service is provided “as-is”

  • SwipeTrack is not liable for indirect, incidental, or consequential damages

  • Direct liability is limited to the amount paid (if any) for the Service in the prior twelve (12) months

Certain consumer or jurisdictional rights may apply.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles.

Courts in Bexar County, Texas have exclusive jurisdiction for disputes relating to these Terms.

11. Updates to These Terms

We may update these Terms periodically and will adjust the “Last Updated” date accordingly. Continued use of the Service after changes become effective means you accept the updated Terms.
